1. Data Collection & Lawful Processing

In accordance with the JDPA, we process your personal data lawfully, fairly, and in a transparent manner. We collect only necessary identifying information (names, emails, contact numbers, and business details). We also securely process image files and design assets provided by clients exclusively for the purpose of executing logo designs or embroidery digitizing. We do not sell, trade, or transfer your personally identifiable information or proprietary files to outside parties. Processing is strictly limited to the provisioning of hosting services, codebase deployment, digital asset creation, and executing secure financial transactions.

2. Your Rights Under the JDPA

As a data subject in Jamaica, you reserve specific rights regarding your personal information:

• Right to Access: You may request a copy of the personal data we hold about you.
• Right to Rectification: You may request the correction of any inaccurate or incomplete data.
• Right to Erasure ("Right to be Forgotten"): You may request the deletion of your personal data when it is no longer required for legitimate business, taxation, or legal compliance purposes.
• Right to Prevent Processing: You may restrict processing that causes substantial unwarranted damage or distress.

3. Security & Breach Notification Protocol

We utilize enterprise-grade encryption (SSL/TLS) for all data in transit and at rest. In the unlikely event of a data breach affecting user privacy, WebhostJA adheres strictly to the JDPA mandate, committing to notify the Information Commissioner of Jamaica and all affected data subjects within 72 hours of verification.

These Terms and Conditions govern your use of the WebhostJA platform, hosting infrastructure, design, and digitizing services. By engaging our services, you enter into a legally binding agreement construed entirely under the internal laws of the State of Jamaica.

1. Acceptable Use & Cybercrimes Act Compliance

Clients must utilize our servers and web applications lawfully. WebhostJA enforces a zero-tolerance policy for activities that violate the Cybercrimes Act (2015) of Jamaica. We reserve the right to immediately suspend or terminate hosting services without refund for any client found utilizing our servers for:

• Unauthorized access, interception of data, or distribution of malware/ransomware.
• Phishing, identity theft, or electronic fraud.
• Distribution of illegal content or unauthorized bulk email (spam).

2. Intellectual Property (IP)

In accordance with Jamaican copyright laws, all underlying proprietary backend code, frameworks, and server-side scripts developed by WebhostJA remain our exclusive intellectual property. The front-facing digital content (text, images, logos) provided by the client remains the property of the client. The transfer of backend source code ownership to a client requires the execution of an explicit IP transfer agreement and a fixed fee of US$40.

Logo Design Intellectual Property: For custom logo designs, full copyright and ownership transfer to the client solely upon the receipt of full payment. WebhostJA reserves the right to use finalized designs in our professional portfolios.

Digitization File Formats: Digitizing services convert client images into machine-ready formats (e.g., Wilcom .EMB, .DST). Native digitizing files remain the intellectual property of the digitizer unless explicitly requested and released under a separate agreement. Final machine formats are provided to the client for manufacturing use.

3. Limitation of Liability & Dispute Resolution

WebhostJA guarantees a 99.9% network uptime; however, we are not liable for indirect, incidental, or consequential business losses resulting from unforeseen hardware failures or force majeure events. Any disputes, claims, or controversies arising out of or relating to these Terms shall be resolved exclusively within a court of competent jurisdiction in Jamaica. If any provision of these terms is deemed unlawful, that provision shall be severable and will not affect the validity of the remaining provisions.

At WebhostJA, we provision high-quality, custom digital infrastructure, bespoke application engineering, specialized server allocation, and custom digitizing/design services. This Refund Policy is formulated in alignment with the guidelines established under the Consumer Protection Act (CPA) of Jamaica.

1. Nature of Custom Digital Services

Under the CPA, consumers have rights regarding defective goods and services. However, due to the unique, non-returnable nature of proprietary source code, domain name registrations, custom web development, logo designs, and embroidery digitizing files, these items are considered custom-made goods and immediately consumed services. The human labor, server provisioning, and intellectual property allocation required to initiate a project cannot be recovered or restocked.

2. Strict No-Refund Stance

Therefore, we maintain a strict no-refund policy once project work has commenced, server space/domain names have been provisioned, or a digitized/design file has been approved. By agreeing to our terms or submitting an initial upfront payment (e.g., the $65 upfront fee or $100 setup fee), you acknowledge that project setup, consulting, and development time represent immediately consumed resources that are non-refundable.

3. Exceptions & Warranty

WebhostJA provides a warranty that our services will be executed in a workmanlike manner aligned with industry standards. For Embroidery Digitizing, we offer a Quality Guarantee where payment is conditional upon your initial satisfaction with the provided proof. Refunds will only be considered under extraordinary circumstances where WebhostJA has unequivocally failed to deliver the agreed-upon digital infrastructure or file as outlined in the client's contract, and such failure is not rectifiable. Client-side delays, failure to provide content, lack of communication, or a sudden change of mind do not qualify for a refund.
